These Terms and Conditions (“Terms”) govern all transactions between the customer (“you” or “the client”) and CIX FENCY , a South African furniture store specializing in couches, bedframes, and custom furniture.
By purchasing from us or using our services, you agree to these Terms in full.
1. Orders & Quotations
All quotations are valid for 7 days from the date issued.
Quotes are subject to stock and material availability at the time of acceptance.
Orders will only be processed once a deposit 50% (or full payment, where required) has been received.
Custom-made items (e.g., non-standard sizes, fabric choices) are made to the client's specifications and cannot be altered once production has begun.
2. Payments
A 50 % deposit is required to confirm your order.
The balance must be paid prior to delivery or collection.
We accept [list payment methods: EFT, debit/credit card, cash, etc.].
No items will be released or delivered until full payment is received.
3. Production & Lead Times
Lead time is estimated at 1 week, depending on materials and order size.
While we strive to meet these timeframes, delays due to supplier or logistical issues may occur. We will notify clients of any material changes.
No refunds will be issued due to production delays unless an unreasonable delay occurs, as defined under Section 19 of the Consumer Protection Act (CPA) 68 of 2008.
4. Refunds and Cancellations
Once production has begun, deposits and payments are non-refundable.
Clients must inspect their item before it is brought into their home. No refunds or exchanges will be considered after the item enters the home, except in the case of a proven manufacturing defect.

5. Delivery and Inspection
Delivery will be scheduled upon confirmation of full payment.
It is the client’s responsibility to ensure clear and sufficient access to the premises.
The client must inspect all items prior to them being loaded into the house.
We are not liable for damage caused due to restricted access or forced entry.
Additional delivery or redelivery fees may apply if the client is unavailable or access is denied.
6. High-Risk Area Policy
We do not deliver to high-risk areas as defined by our delivery team and third-party logistics partners unless prior arrangements have been made.
If delivery to a high-risk area is agreed upon:
The client will be required to pay a Service Protection Fee (SPF), the amount of which will depend on the delivery zone and risk level.
The SPF is non-refundable and must be paid before dispatch.
We accept no liability for any loss, theft, or damage incurred in or en route to high-risk areas. The client accepts full responsibility once the goods leave our premises or the delivery vehicle enters the area.
7. Warranties and Defects
All products carry a [insert duration] warranty against manufacturing defects under normal use.
The warranty does not cover:
Misuse or abuse
Water damage or staining
Damage caused by moving or incorrect assembly
Claims must be made in writing with photographic evidence within 7 days of delivery.
8. Limitation of Liability
We will not be held liable for:
Any incidental or consequential damages
Delays in delivery caused by external couriers, suppliers, or unforeseen circumstances
Theft or loss in high-risk areas where a Service Protection Fee has been waived or not paid
Damage resulting from customer handling, misuse, or negligence
9. Intellectual Property
All content on our website, including images, designs, and text, is the property of CIX FENCY and may not be copied or used without prior written permission.
10. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa, including but not limited to:
Consumer Protection Act (CPA) 68 of 2008
Electronic Communications and Transactions Act (ECTA) 25 of 2002
Any disputes shall be resolved in a competent court within the Republic of South Africa.
